welfare fraud ?

My friend's fianc�, who has faithfully paid child support, was hit by the state of ND with an order to repay the welfare benefits his ex-wife defrauded the state of. Not only did she commit the fraud while collecting CS from the ex, she also committed the fraud while collecting money from her live-in boyfriend. I would use this argument: What if the ex-wife committed robbery? Would the ex-husband be responsible for that, too? Or is it that it's just easier to hit him up because they know where he is? To make the unknowing ex-husband responsible for his ex-wife's welfare fraud is like charging him with an accessory to fraud without having to prove the fraud. What's the deal here?
