Legal Question in Family Law in New Jersey

Wife cheating with janitor at kids school

I am devastated.

I have 3 kids age 17, 15, 12

Married 18 yrs

Wife cheating with janitor at kids school

Isn't this a kind of child abuse?I've been

told wife's lack of character is not

concern of the court?

What are my chances of winning

custody?

Would she be responsible for child

support?

Will I have to pay her alimony? How

long?

She has told me she's gonna take me

for everything I got.

My check is direct deposited in a joint

acct, can I move it to another account?

We have 2 cars

My home is @ 185-190,000

mortgage 1200 month

I have 401 k of 115,00

lesss than 1,000 in bank acct

That's about all my assets.

I've been told Jersey is one of the most

unfair to fathers states in the world...by

my wife!

Is this true?

I am very active in my kids lives,

coaching their teams in basketball, etc.

I am very financially strapped.

Are there any inexpensive or pro bono

law services for a man in my position?

Can this be handled by an online Quick

Divorce site? Even if she already has a

lawyer?

Please help.

Well, I have heard a lot of stories, but your story is pretty brutal. Sorry to hear it.

NO, hell no, do not use a cheap divorce site. Your entire life, your kids' lives, will be affected by how you handle this divorce. And no kidding, I have never heard of a woman (or man either) who goes out and cheats, then promises to take everything from the spouse.

You have many serious questions. Please hire an experienced divorce attorney who spends a large part of his or her time on divorces, and find someone located not too far from you. Yes, it will cost you a good deal of money, but you have to have a decent attorney. In addition to the things you are worried about, here are more issues: Your pension (if any), your kids' college education, who pays the debts you now have.

Custody: I need a lot more information to give you any advice, but the Courts are NOT supposed to automatically give custody to the Wife. Tell me more, and I could tell you more.

Dont wait. Go see an attorney.

If you would like, give me a call; I am in northern New Jersey. The telephone consultation will be free. I would be happy to help you out.

Re: Wife cheating with janitor at kids school

Hi,

You have raised some very serious issues that cannot be handled online (I am not even sure what this means except to order forms that propbably are not correct and a waste of your money).

If she has an attorney, you need to get an experienced divorce attorney near you. DO NOT WAIT, and do not get cheap here. While she cannot take everything, if she has an attorney, she can definately put you behind the eight ball.

You asked "What are my chances of winning custody?"

This question cannot be answered online. It is very fact specific. Also, custody does not determine who pays child support. It has to do with the parent that is designated as the Parent of Primary Residence or "PPR".

You asked, Will I have to pay her alimony?

Again, depends on many factors, the most important being the length of marriage.

How long? See above.

She has told me she's gonna take me for everything I got. I have never seen this in my 16 years of practice. New Jersey is an equitable distribution state.

You have raised other questions, but to answer them, you need to provide more information, or call an attorney and schedule an appointment.

Again, I would immediately seek the services a qualified divorce/family law attorney.

Please call my office if you would like to schedule an appointment with me. My contact information can be obtained from the links below. Let my secretary know you found me through LawGuru, and I will give you a free initial consultation.

Good Luck!
