Legal Question in Family Law in New Jersey
My wife and I have been moving towards divorce. She have been verbally assertive and made several threats to have a restraining order issued because she is afraid of me. I have don nothing verbally or physically to justify that action. I hence with the advice of friends kept a recorder on my person or in the house. She has hacked my email which she showed the web pages but says I wont have proof. In addition she has said when I file she will press changes for the recordings and make it very, very, difficult for me stay in the house. I cant afford to pay the mortgage and move but I'm afraid. How will the court see me when I file, not pay the mortage, I have never missed a payment in 12years.

If is perfectly legal to record in New Jersey any conversation to which you are a party. It is not harassment. Recording her private conversations on the telephone would be improper.
Secondly, she needs to understand that your ability to continue paying the mortgage depends on your staying in the house and you and she need only agree to be civil, while giving the other his/her own space. Perhaps a letter from a lawyer would help in this regard.
