Legal Question in Family Law in New Jersey

Ex Wife is moving kids out of state

My ex, who is the custodial parent of 2 minor children, is planning on moving 1200 miles away. I pay child support every week with no arrears owed in case that is questioned. Per divorce she is not allowed to move from her present area without written permission from me or the courts. I am not giving permission because she will not agree on a set visitation for the children. She is basically saying ''so what''. What could happen if she moves them. This is a divorce granted in the state of New Jersey. She now resides in delaware and plans on moving to the western part of Missouri.

You have options, but much will depend on the details. You need to get to a divorce attorney. This bulletin board will not solve your problem. Be prepared to hire an attorney and fight her. Good luck to you. If I can be of assistance, please contact me.

Without more information I cannot begin to even address any of the issues. First, how did she get to Delaware, she would have needed the permission of the New Jersey Court. Next, depending on how long she has been in Delaware I am not sure whether you would need a New Jersey or Delaware attorney. I do know that you should immediately hire an attorney before she moves again and makes it even more difficult. Please feel free to call for a free consultation. Good luck.
