Wife becomes pregnant while separated

My son and his wife separated after 9 months of marriage. They have an 11 month old child together. She presently has the child living with her. She was seeing someone while married to my son and since my son has left she has now become pregnant with this other mans child. She is presently 6 months pregnant. She also has a child from another man other than my son and the man she is with now who is a toddler and she also gave up a child for adoption at the age of 15. They are not divorced yet as visitation has been a problem to agree on. My son has just found out that she is 6 months pregnant and wants custody of his child. This child she is pregnant with is the 4th child she is having out of wedlock. My grandchild will only be 14 months old when this new child is born and my son would like sole custody of his child as he feels he can offer a better environment for his child and much more attention. Can you tell me what his chances may be?

Thank you for your inquiry. I believe that it is quite important that your son file for custody right away. Otherwise, the longer he waits, his chances of being awarded cusotdy diminishes.
