Legal Question in Family Law in New Jersey

Wife sue husband's Mistress

I am married and my husband may have fathered--name removed--child with another women. She was awarded child support, because my husband signed--name removed--paper saying that he is the father. He said he didn't sign the paper, but they showed it to him and said he still has to pay. My question as--name removed--wife, I was told that I will be responsible to pay if my husband can't. How can I stop this action, we have four children and in debt.

Please help...

Re: Wife sue husband's Mistress

First, this is not your child and you have nothing to do with it. Thus, you don't have to pay anything to anyone. Of course, if he doesn't pay, he will be subject to arrest and that may impact you. Second, if this is not his child he should get a DNA test right away and find out for sure.

To work all this out, I suggest he get an attorney as the law in NJ is if you don't do anything about it for a long enough time and then find out many years down the road that it is really not his child, he will still have to pay. Thus, it is important to stop this now and do it the right way.

My initial consultations are always free, so call me at 732/247/3340 and we can discuss the case. I'll be in the office most of the weekend so you can call and leave a message if you'd like and I'll call you right back. Otherwise, you can email me.
