Legal Question in Family Law in New Jersey

i was wondering if i can get charged with kidnapping if i leave state

i am being mentally abuse and lied too constantly i just cant take it anymore. i'm going to be filing for divorce. we have a 6 month old. an i have other children but live in n.c. and i want to go back there so we can all be together again. but my husband now says he'll kill me if i leave.

Well that depends on if he makes up some story and the authorities believe it. It is not kidnapping per se if you left with the child but if he goes to court and files for custody/visitation the judge can order you to come back.
