Legal Question in Civil Litigation in New Jersey
My 7 year old autistic daughter tossed a shell in the air at a backyard confirmation party and it hit the hood of a car parked in the backyard. This caused a dent the size of a pinky nail in the hood and the owner got an estimate of $339.00 to fix it. We do not have all the money at this time can, we send the owner 3 payments payable to the body shop?

You can agree to do anything but of course, it takes two to agree. I think $339 is rather steep, but what are you going to do? You could agree to have them get the work done, provide you with the final bill, have them pay the body shop and then you make 3 equal payments on set dates. Sounds fair to me.
To Mr. Henninger's advice, I would add that as a condition to you reimbursing the other party, you have them give you a release from all claims. This will prevent them from suddenly "finding" new dents and dings that allegedly were caused by your daughter.
I would be a little tougher on them. They want money from you for your 7yr old's actions, let them sue you. a little dent is just that...and you do not take money from your neighbor's pocket to fix it, you leave it there forever. this is not nice by them.
