My brother in law received my father in laws banking information and SS # back in August 2012.
Angel A. Arce (this is my brother in laws) legal first name is the same as my father in law and of course the last name, making it easy for him to commit this crime.
Albert opened a fraudulent savings account at the same bank my father in law banked with; which is PNC bank. His aka Albert transferred (on line) 12k in one week to the new fraudulent saving account, he also forged the signature card.
Once the bank (PNC) out of Bloomfield N.J., spoke with my father-in-law and realized this was done illegally they froze the accounts.
Albert contacted the bank (PNC) and admitted to the PNC bank officer he was the person who open the account with out my father in law knowledge.
Albert went to the hospital where my father in law was staying and told him if he did not give him power of attorney he would be arrested taking him away from his wife and children.
In October 2012 my father in law signed the Power of attorney for Albert. On that day my father in law was sick in the hospital the family feels Albert bullied him into signing the power of attorney so he (Albert) would not be arrested.
The first crime Albert committed back in August 2012 was he went to my father-in-laws apartment in Bellville,NJ and removed all my father-in-laws furniture, personal affects, banking information, legal documents, took his 2008 vehicle, his wallet, credit cards all his ID left him with nothing.
In Sept 2012- Albert works at the same government job as my father-in-law did. According to his employer they stated, Albert also forged my father in laws retirement paper work and life insurance.
My father in law passed away January 31, 2013.
The hospital claims are they called Albert at 2:30 am on January 31st, 2013 asking him to come to the hospital he refused and instructed them DNR.
I am suspicious how Albert new to remove 55k on January 30th, 2013 the day before and made arrangements on the same day to have the body immediately cremated the following day. Yet my father in law - Angelo Arce was listed in stable condition.
Albert did not contact any family member's to make us aware he was having my father in law cremated .
On January 30th, 2013 he (Albert) went to Bongiovi Funeral Parlor 416 Bell Ave. Raritan NJ as asked for my father-in-law to be cremated.
How did he know to make funeral arrangements the day before ?
We also found out this past Friday 2/15/2013 that Dr. Patel my father-in-laws doctor for a long time new his medical history.
Dr. Patel was surprised to here he passed away.
Dr. Patel told my husband Abner on Friday 2/15/2013 , she was removed by Albert several months ago and was replaced by another doctor. Family members where not aware this decision was made.
Does the power of attorney give him that right to not resuscitate? We have contacted the patient advocate at Somerset Medical Center NJ they will not release my father in laws medical records to us or show us the power of attorney.
My husband contacted the hospital to find out where they sent my father in law. He called the funeral parlor to find out when the services were being held and the owner Anna t he was scheduled for cremation that day.
Abner told her; �Do not cremate my father until all my sisters and brothers are contacted especially because there was no will.
Bongiovi (Anna) the owner said Albert had the power of attorney so they moved forward with the cremation. No one contacted or consulted any of the other siblings. My husband told the owner of the funeral parlor when someone dies the POA means nothing. He requested the funeral parlor to stop the cremation. Bongiovi did not listen and moved forward. They did not have a service for my father in law and we have no idea where his ashes are.
Can we file charges against him? Sue the funeral Parlor?
