Legal Question in Civil Litigation in New Jersey

car vandalism in wildwood hotel

My car windshield was shattered at a wildwood, nj motel in the designated spot they gave me. Car had to be towed to Philadelphia. Motel has no written policy that they are not responsible for damage to vehicles on property or my receipt. A police report was made, pictures taken by cop. When asked if motel's insurance would cover this, motel stated ''no, that's common knowledge''. They provided no further information. I asked if I could see their policy that they are not responsible and they said ''We have nothing prepared but I'll write one up for you.'' I declined offer. Are they responsible? How do I contact their insurance company? I have no idea how to pursue this matter.

Re: car vandalism in wildwood hotel

Generally, a landowner or business owner is not responsible for the criminal activities of third parties, unless they had prior knowledge of acts of vandalism occurring beforehand, and did nothing to prevent. If you had comprehensive coverage in your motor vehicle insurance policy, they should cover it, less the deductible. Otherwise, you're probably out of luck. The cost of a new windshield is probably 3 to 5 hundred--not worth filing suit over or hiring a lawyer.
