Charitable Immunity

My husband's car was parked in a school assigned parking space and was damaged by students playing football in the lot...the school was notified 1 month prior that damage to cars might be imminent. School officials verbally assured my daughter that the school would pay for the damages. They have now stated that they are not insured for that type of damage, and are covered against lawsuits by Charitable Immunity. This is a private school where tuition is in excess of $8500 per year. They plan to file a motion to dismiss at our small claims hearing on Sept. 3, but want us to grant a continuance so they can have their lawyer prepare the motion, and also as the Rector at the school will be unavailable. Should we give up?
