Legal Question in Civil Litigation in New Jersey

Condominium General Litagation

I love in a small condo development, where the montly maintenance fee is the same for all condo's regardless of size, # of rooms, floors, garages. Up until recently there were no parking restrictions, now they say you can only park one car in your driveway outside of your garage, or pay a $35 a month fee for the 2nd car. Two cars can fit in the driveway by the way in the 1 car condo units. Condo bi-laws say unit owners are responsible for maintenance and repair of their own driveways. I feel if we are responsible for our own driveway we have the right to park 2 cars in our own driveway without paying extra fee's. Also the units with 2 car garages who pay the same monthly maintenance fee as units with a one car garage are allowed to park 2 cars in their driveway one in front of each garage with out paying a few. I would like to let them take me to court on this issue and want to know if I have any legal leg to stand on?

Your situation is a bit messy, and the final results are not guaranteed. But, yes, you do have an argument in your favor.

It is unusual, very unusual, for the condo dues to NOT be different for different size units.

Do you have the 'public offering statement', the very thick book of legal documents? You should have gotten it when you bought the unit. The documents will help any attorney who gives you advice.

If you would like, give me a call to set up an appointment; I am in northern New Jersey. The consultation may be free, speak to me and I will let you know ahead of time. I will do what I can to help you out.
