Deadline to start Discovery in NJ

A civil lawsuit was filed against me to which we responded within the required 35 days in NJ county court.

My attorney kept delaying starting the DIscovery process ( request for information and documents) because he has been too busy. After 45 days, I have contacted another attorney to take on the case.

He says in NJ the discovery process must start in 40 days which was never mentioned in the SUMMONS or any other place.

Is 40 days the deadline for start discovery in NJ?

What are my options at this point? a total of 55 days have passed since fileing the response.

Is the previous attorney liable for not starting or informing about the deadline?

It seems you may want another attorney to consult (for a fee) and review all of the paperwork. There are deadlines, but your attorney (attorneys at this point) should give you clear guidance as to how to deal with all of this, and what it is that the attorney must do for you. No one is answering your questions.
