Expired car insurance

I was in a motor vehicle accident. I was hit by a vehicle that had inactive insurance. He provided the police with his card at the scene and it was dated as valid. How do I go about getting money for the damages to my car? My car insurance will pay for damages less the deductible. I don't think it's fair that I need to pay for that.
