Legal Question in Civil Litigation in New Jersey

Can I file a civil suit against malicious relative?

With visual confirmation from my husband, a relative of ours took photos of my husband taking out a neighbor's recycling during his work hours. We are not on speaking terms with this relative due to a conflict in the distant past and she has been out to get revenge on my husband and obviously holds a ''vendeta'' towards him. These photos may have the potential for loss of employment. He has been singled out clearly for malicious reasons. Clearly she was not trying to come to the aid of the employer but rather she is out to make my husband's life miserable with intentions of him being reprimanded or fired. If he does lose his job can a suit be filed against her for clearly ''malicous intentions or harrasment?'' She simply wants to ruin his life.

Re: Can I file a civil suit against malicious relative?

You can file suit against anyone for anything. Ho9wever, there is no merit to such a suit. Exposure of the truth is almost never a malicious act nor would it sustain a cause of action. The truth is generally a defense to any statement made, whether orally or by act, such as video.

Your relative is likely to stay a thorn in your side. Make sure you do not do anything rash which might create more problems and make them the winner in this game of psychological warfare.
