Legal Question in Civil Litigation in New Jersey

I need to file a motion to enforce litigant's rights. I have the mortgage signed and the mortgagee has been making payments but refuses to release the documents from escrow so they can be filed with the County. First, do I need to file a legal argument with my motion? Second, are there any cases that force a release of documents from escrow?

You can't file such a motion unless there is a case in court. I am not sure why documents would be escrowed or what such a function would serve.
