Legal Question in Civil Litigation in New Jersey

my husband has expired while during visit to India. I came to know that in most of the bank accounts,my husband has nominated his nephew as beneficiary of bank accounts after his death. Under these circumstances,i have no sufficient money to survive in US so i wish to shift to India,my native place which is comparatively cheaper place to live. We were both US citizens and were enjoying social security benefits. Kindly let me know weather i can get some money from the bank accounts of my husband where he has made his nephew as sole beneficiary after his death as per US laws. I have been advised that i can still get one-third money under US laws for my survival.Is it correct?
