Legal Question in Civil Litigation in New Jersey

Internet Slandering

I have recently been subject to humiliation and slandering on the dontdatehim web-site. Am I allowed to sue them and ask for information surrounding finding out who wrote this stuff about me? They even listed my home address and full name.

Re: Internet Slandering

Your rights to sue a provider of information on the Internet are limited. You can, however, sue anyone who libels you even if you don't (yet) know their name. Your lawyer would file a "Jane Doe" suit and subpoena the identity information from the ISP. They have to keep it for ninety days and they have to provide it in response to a subpoena unless the other party can show a valid legal reason why is should not be disclosed.

Defamation (libel and slander) are not the only causes of action that might be available to you. Invasion of privacy is also useful in many such situations and can apply even if a disclosure was made by the other half of a private relationship.

You should consider an invasion of privacy or a defamation action. Feel free to call our offices or e-mail me directly to discuss.
