Legal Question in Civil Litigation in New Jersey

Is This Kind of 'Revenge' Legal?

I was unmercifully bullied and harassed by ex-co-workers for two years at my former workplace. It finally became too emotionally and mentally painful for me to work there and I quit (with good cause, I believe) anyway, I was on the web looking at so called revenge sites that offer to send people you want revenge on things like dead roses, voodoo curses, etc. My question is can something like that come back to bite me in the backside if I did do something like that. I have already suffered enough and I certainly don't want to be get in trouble criminally or civilly as a result of using these 'revenge' services. Please advise.

Re: Is This Kind of 'Revenge' Legal?

Arguably what you propose is itself harassment. Legal or not, it only compounds your problem and would virtually eliminate any opportunity that you may have for a legitimate remedy.

There is both State and federal legislation and case law that prohibits harassment. It is usually applied to discrimination cases and cases involving sexual harassment. Whether or not that is your situation, some of it may apply to your circumstances. The term usually used is "hostile workplace environment." Your employer is obligated to provide a workplace that is free of such an environment.

The key to a hostile workplace environment suit is employer notification. You can't just sit back and take it; you have to report it and give your employer the opportunity to correct the situation. The exception is one in which the managers are themselves involved and there is not reasonable opportunity to raise the issue to a different level.

If you meet the threshold criteria, you may have a good case against your former employer. That IS legal and perhaps the best way to serve up your revenge. At least, it tends to get everyone's attention.

Consult a lawyer whose practice emphasizes civil rights or employment law. If you don't know one in your area, call your local lawyer referral service. They have a list of lawyers in your area who take cases in various areas of practice. The fee for a first consultation is usually nominal. In an appropriate case, a lawyer may agree to take your suit on a contingent fee. Contact the Middlesex County Lawyer Referral Service at 732-828-0053 or on the web at www.mcbalaw.com.
