Legal Question in Civil Litigation in New Jersey

need help

my lawyer has died during my case, ( a personal injury) but while looking for a new lawyer, i found out that alot of my files are missing and no lawyer wants to handle my case. is this grounds for a malpractice against his estate? and one of the lawyers who i seen wants to be a witness in the possible malpractice case
