Legal Question in Civil Litigation in New Jersey

My family owned a business for many

years, then sold it to a large

corporation. My cousin worked for the

business and recently left it and

started on his own, with the same

name. The business has now

contacted me and wishes to employ

me as a consultant, to put me in ads,

etc. to drum back business. Am I

opening myself up to any legal

problems from cousin? Should I ask

for indemnification?

I need more information before I can respond to your questions. For example, what business contacted you to act as a consultant? The former family business? Your cousin? If it was your cousin, were you one of the owners of the family business? If so, what restrictive covenants (if any) were part of the agreement to sell the business? In general, New Jersey looks at restrictive covenants fairly narrowly. However, restrictive covenants that are part of a sales agreement are strictly enforced.
