Legal Question in Civil Litigation in New Jersey

Negligance

Although doctor's and hospital staff recommended my mother receive nursing home care because of dementia, special diet, exercise programs, and constant monitoring my brother removed her from a nursing home, and provided her with no special assistance. She died within 3 months. Can I take action against him for negligent death.
