What Options are Available?

I am a consultant. Two years ago I moved to NJ to be near my family. I recently learned someone posted on an industry webpage that they tried to locate me but there was a different name listed at my address (my old address from two years ago) and the person then wrote that I am a ''questionable person'' because I am not at the address that is on my business card. I contacted the person and they will not take their posting down about me. To make make matters worse another website is now posting the same information. I am now reluctant to do any marketing out of concern that new clients will find this webpage. What should I do?

You are being slandered. Enforcing your rights will apparently need a lawyers' help. This idiot has now refused to take down false derogatory statements when you asked nicely.

You could file an action against these individuals seeking an Order requiring that they cease and desist from posting said statements on their websites. Before you file suit you could have an attorney write the owners of the websites threatening suit and demanding that they cease and desist from their conduct regarding their websites.

The law of the Internet has developed to provide rather broad protections to ISP's, blog publishers, and similar entities. That means that a defamation suit is difficult to win except against the person who made the original, false statement. There is also a question as to whether being labeled as a "questionable person" is defamatory in the business context. That said, there is frequently merit in taking an agressive approach in these situations. It is possible that, when faced with the likelihood of defending a lawsuit, the other parties will see things differently.

You must decide for yourself the business value of fighting this matter. It is unlikely that you will ever be able to put a real economic value on it. If you think that it is hurting your business enough to be worth fighing about, hire a lawyer and go to it. You should not expect to collect money damages, but you will probably be able to correct the false information.
