Who Owns the Engagement Ring when the Engagement is Broken?

My fiance and I recently split up. He is the person who broke the engagement. I do know that the laws on Engagement Rings have been changed since it is considered a promise to wed. What I want to know is since he broke the engagement do I still have to return the ring or would it be considered mine since he broke the promise?

If you want, I could check the specific New Jersey law on the issue (at a fee), but the established common law is that an engagement ring is a gift in consideration of marriage. If the marriage does not take place, then the ring should be returned.
