Legal Question in Civil Litigation in New Jersey
school bus accident
My son is in a wheelchair. His bus company sent a driver and aide for him and did not give them instructions on his special needs. By the time he got home he had a fractured foot from the wheelchair being tied down incorrectly. He had pain, and is now afraid to get on the bus. What would be a fair settlement for him? I feel that the bus company was negligent, since his care is spelled out in their contract.

You should definitely speak to an attorney about this case. It seems like there is clear liability against the state and the company contracted to take care of your son. Time is of the essence. Feel free to call us or you can e-mail me directly to discuss.

You should consider seeking counsel from or a free consultation with a personal injury or insurance defense firm. Redress for such injuries will ultimately require negotiation with the insurer of the bus company. If the bus is operated by government, or the driver a government employee, a different set of issues might be present, including possible limitations of liability.
