Legal Question in Civil Litigation in New Jersey
My sister was at a party and when the cops arrived they took everyone there to the police station to get their information and to release them to their "guardians" because they were all underage. They cited my sister with possession and consumption of alcohol but they never asked her if she drank and never performed a breathalyzer on her. There is no evidence at this point that she had consumed alcohol so it wouldn't hold up in court but she was still cited with possession and consumption. How easy would it be to contest the citation? What would have to be done to contest it?

First of all who are the States witnesses as to your sisters consumption and possession. Remember mere attendance at a party where liquor is served is possession whether or not you actually consume. Set up an appointment with my office.
