Legal Question in Civil Litigation in New Jersey
My son entered private senior high school year in September 2010. Prior to this in June, 2010, the father told the school that since he closed his business, he could no longer afford the tuition for his senior year. In September, the mother registered the child for the senior year. The mother has no means to pay the school either. The father stated that he could no longer afford the private school tuition to the school and the mother and the father did NOT register the child. The school sent the tuition bill to the mother. The school says that the father does not have to pay, only the mother. Now the mother wants to sue the father for half the tuition. Does she have the legal right to sue if she knew that the father could not afford the school tuition? The school knew prior the the new school year that the fathers business was shut closed and so did the mother. The father is currently unemployed and not collecting assistance. The mother is unemployed and IS collecting unemployment.

I am assuming that the mother and father are divorced or maybe were never married.
I would need to look at all of the Court Orders in this case, and any divorce agreement or any other agreement between them.
Private high school is expensive, and the parents have to be able to afford it.
