Legal Question in Civil Litigation in New Jersey

How do I subpeona records of the defendant?

I have a civil lawsuit against a company for breach of contract. I have a contract that states that I was to be paid 50% of the revenue I generated, plus 100% of all gratuities. They paid me only 30% plus 20% gratuities. I am suing for the other 20%. I want to subpeona the invoices they sent to their customers for the work I did, to prove that they charged and collected the gratuity, but did not pay me those gratuities.

You have aright to receive copies of these documents as part of the discovery process. You will get further if you are represented by a lawyer.

Should you like to discuss this or any other legal matter you can e-mail me for more information about low cost face-to-face, on-line or a telephone consultation with a lawyer in our office.

If you are already involved in the lawsuit, you are entitled to that information without a subpoena. You must send a Request for Document Production also known as discovery. You can get the basic forms to do this on the Courts website or by calling the Clerk of the Court that your case is in.

You may be better off seeking an attorney in this matter if there is a lot of money involved.

good luck.
