how do i sue a photographer who said they can't fined our wedding pictures from 8 years now

You may want to think through the basis for the lawsuit. Was the photographer under an obligation to retain the pictures for 8 years? Was a time frame stipulated in the contract? Do photographers generally retain pictures for that long? It sounds like you may have trouble establishing a legal basis for relief.
