How to get back my money that my insurance co. paid the provider
I went to a Chiropractor clinic for my back. He was not in my plan. I paid in full up front. When they submitted to my insurance co. they failed to check the box for payment to come to me, so payment went to them. They claim it was deposited into the DR's account. The doctor according to them, was under contract with them and he has since left the clinic. They tell me I have to go after him to get my money back. The paperwork I signed was not with the DR. but has the clinics name etc. on it and the checks were made out to the clinic. But the clinic states they only handled the money for the DR. and then he paid them fee's for his practice there. Can anyone suggest what my next step is? I have spoken with the DR. and he said they took all the money and he never got it. Any help?? thanks Not sure what law this falls under.

Sue them both and let the court sort it out.
