Legal Question in Health Care Law in New Jersey

Hi,

Two years ago my son who was 4 at the time had dental work preformed in a NJ hosp under sedation because he has autism.

My dental ins paid the Dentist & I paid the balance of the dental bill.

After 1 1/2 yrs BCBS paid the anesthesiologist.

BCBS refuses to pay the hospital even after I filed 3 appeals & provided them with letters from my sons pediatrician & dentist stating that the procedure could not be done in office plus a copy of NJ state law.

The dentist had told me prior to the procedure being preformed that under NJ State Law a hosp cannot deny treatment to a disabled child under age 5.

I am now being sued by the hospital for $5,000.

If my insurance paid the anesthesiologist why are they not paying the hospital?

Where do I stand?
