Adding spouse in Adjustment Of Status application

Hi,

One has his adjustment of status application(I-485) approved but has noe taken the stamp in his passport. Can he at this point add his spouse(who is overseas) in his application and get green card together.

Also can the spouse come with a valid H-4 visa at this point.

If the approval has arrived in the mail and you simply have to go to the local INS office to get the stamp, then it is too late. Your sposue should have been added to your petition before the approval. You will have to file for her separately.

With regards to the H4, your wife can only come over on an H4 if you have a valid H1, which doesn't seem to be the case any longer.
