Bringing my spouse to live in the U.S.

Hi,

My spouse was a student here in the U.S. and he is leaving the country soon because he is done with school. I would like him to join me here as soon as possible. What paper work do i have to file and can I have an estimation to how long it will take him to be here. I understand that there is a K-3 Visa that he can apply for to join me here. how long does he have to wait to apply for that and does he have to do to get it.

There may be various options for bringing your husband to the US (possibly including a K3 visa). However, that is just one option and it actually depends on what your status is here in the U.S. What I typically do is sit down with my clients and present them with the various options available and let them make the decision based on the time frame and convenience. If you are a US citizen and your spouse is in the US why would you want to bother with a K3? He can simulataneously file an I-130 with an I-485 and never have to leave the US to get a green card. If you are not a USC, then he wouldn't be eligible for a K3. From what I hear, the K3 takes a long time, more than 6 months. It's not a viable way to proceed unless you have no other choice which you do since fortunately, your husband has not left yet.
