Legal Question in Immigration Law in New Jersey
Brought here as a child.
My sister's boyfriend of 5 years and father to her 3 children is an illegal alien. We live in NJ. He was brought here as a small child from Mexico. I am not sure of the age but I can find out if necassary. He attended public schools.. Were my sister met him and began dating him in High School. When she became pregnant he confessed to her that he was not legal. He is now 20 going on 21 next month. Now she lives in fear that her children's father will be taken way. .Especially since he is the one who financially supports the family. What can they do if anything to try to get him legal. They are afraid to go to the INS because he might get deported and her children as well as her would be devastated. please give any advice you possible can... thanks

He should consult with an attorney to discuss any immigration options he may have. An attorney will need to know his full immigration history as well as his family's immigration history. Additionally, if he has any criminal history, he should be prepared to discuss this with an attorney.

Whether the father of your sister's children is eligible for immigration status depends upon a variety of factors, including how he entered the U.S., whether he or his parents ever made any applications, and whether he has ever been in immigration court proceedings. Your sister and her companion should make an appointment for a consultation to discuss the issues and whether he is eligible for any immigration benefit
