Legal Question in Immigration Law in New Jersey

Child Status Protection Act

This is in reference to the revised CSPA Act (Child Protection Act) which was recently amended to cater to people who aged out over 21 years of age and werent eligible for the GC.

Background:

Beneficiary Name: Mr Y

(Mr Y is Father to Mr X)

Preference Category: F4 Brothers & Sisters of US Citizens

Priority Date: 24DEC1991

Foreign State Chargeability: India

Beneficiary Applicants: Mr X, Mother & Sister

Appointment was scheduled for Interview: Dec 01, 2004.

Result of Interview: Mr Y, Mother & Sister received Immigrant Visa + GC. Mr X DID NOT attend interview based on advice from lawyers due to being aged out. (Mr X: DOB 12/31/1982)

Based on the revised CSPA am I (Mr X) eligible for the GC?

If I am eligible do I have to reopen the case or file some other paperwork?

What cost would be associated with this?
