Legal Question in Immigration Law in New Jersey

US Citizen to Bring wife to US

My wife is a canadian citizen with TN visa. SHe has been in US since 2002. We got married in July 2005 in NJ. Her TN visa expires in Mar'07. I have applied for my US citizenshipin Nov'06. its highly likely that I wont get the citizenship before Mar'07. So my wife plans to leav US before expriration of her VISA. Now my question is that How much time will it take for me to bring my wife back to US after I have received my Citizenship and what type of VISA will that be (K Visa?)?

Thanks in advance

The correct visa would be a K-3 visa. There is also a possibility of applying for an immmigrant visa at the consulate in Canada.

It may take a few months to get the relevant approvals from the USCIS in order to obtain the visa interview in Canada.

Is your wife or her company unwilling to extend her TN visa? It will certainly take a few months for you to bring her back on a K-3 visa. However, there may be other options for her to stay here while you process her green card. Feel free to contact us if you want to discuss your case in more detail.
