I am married to an aggravated felon from haiti. we have 2 children and i just recently been diagnosed with a mental illness, does my illnes hold any weight towards the deportation

The answer is subject to when your husband entered the USA, whether he entered legally or illegally, the degree of severity of your mental condition, and how dependant you are on him for your daily living and the care of your children. He "may" be eligible for cancellation of removal, contingent on your answers to the latter questions. If the Immigration Judge concludes that removing your husband constitutes "extreme hardship" for yourself [provided you are a United States citizen], he may a chance. Notably, his aggravated felony offense should not be a crime of moral turpitude or a crime involving a controlled substance. Please seek guidance of an experienced Immigration/Criminal Attorney before proceeding with his defense in Immigration Court.
