Legal Question in Immigration Law in New Jersey

expedited process in N-600K cases

In N-600K cases, if the uscis anticipated date for process is beyond the child 18th birthday, and the application was filed a year in advance of the 18th birthday, can an expedited process be requested? and what is the criteria? taking into consideration that the N-600K should take 3-6 monthes to process, but due to backlog it will take uscis a year to process.

Re: expedited process in N-600K cases

Dear Sir/Madam,

Your case may fall under the protection of the Child Status Protection Act (CSPA) which was signed into law in 2002. This would allow an individual who "ages out" to keep their priority date due to USCIS backlogs.

You should consult with an experienced immigration lawyer to ensure your case is protected.
