Legal Question in Immigration Law in New Jersey
If my fiancee has been arested for driving with out a driver license, also got a ticket for ilegal weapen "butterfly knife", and he also spend a day in prison for not paying his traffic tickets and he paid the fined of $1000. and he also got arested for having mariguana. And now a few days ago narcotics unit arested him for having mariguana and they ask him questions and then they told him that they were going to send him a court date because they found his record of unpayed tickets. And then they let him go after that. My question is if he goes to court are they going to deport him or arest him or they just going to make him pay and amount for all the tickets unpayed?

Hello,
You didn't mention what status your Fiance has. Is he a permanent resident, temporary visa or no status at all? Generally, you are not put into deportation for marijuana arrests unless, the government believes you are a dealer. One possession of Marijuana conviction can be excused if the amount is 30 grams or less. A second marijuana possession conviction or one conviction for an illegal drug other than marijuana drug is very bad. Please contact my office at (860) 524-5141 if you would like a consultation.
