Legal Question in Immigration Law in New Jersey
Green card through marriage
Hi,
I came to the US 10 years ago as an au pair from France. I then applied for--name removed--student visa that expired in 2006, the year I married my then fiance. He's American. We decided to file for papers now, we could not afford to do so earlier. Will this wait affect the process of the paper work? Will we have to pay--name removed--fee for not filling for papers right away since I lost my student status. One last question (I hope all this is clear...), how much does the whole process generally cost (lawyer, forms...).
Thank you for your precious help.
Best regard.

Re: Green card through marriage
First, you should seek assistance from an immigrtaion attorney to determine if you are now eligible to file for your green card. An attorney will need to know your immigration history and criminal history (if any). If you are eligible, then filing a few years after marriage, generally, will not cause any issues.
The filing fees for the application (if no waiver is required) are $1,365.00. Attorneys fees vary. You should certainly consult an attorney prior to filing any application with USCIS.

Are you working and paying taxes in this country?
Do you have any children?
Normally a Lawyer's fee that is charged inculdes the filing fees that the government charges to process the Immigration paperwork.
Fees are also charged on the amount of work that each case involves.

Generally, if you entered the U.S. legally and are now married to a U.S. citizen, you are eligible to adjust status to that of a U.S. permanent resident without the need of a waiver.
I would recommend that you consult with competent immigration counsel to assist you with the process. We can provide you with reasonable fixed fees for the process. Please contact our office for our fixed fees.
