Legal Question in Immigration Law in New Jersey

H1B transfer

Now i'm on OPT and i got H1B approval from a company.now i got a fulltime job in another company and want to transfer my H1B.

my hiring date starts from june'02.

just in the last week i got my approval letter but it is with my employer.

i don't have any payslips because i didn't worked yet for previous company.

can you provide me different ways to resolve this issue?

I would have to see what evidence you DO have of your H-1B approval. Can you at least get a copy from your employer? Do you have a copy of the filing itself? Canceled check? We would have to sit and see what information you can dig up and proceed from there.

You will need to file a new H-1B application for a change of employer.

I recommend that you and your new employer consult with an attorney to discuss these issues.

Because you have been counted towards the cap, you will be able to file for a transfer to the new employer by submitting the most recent approval along with the application.

Of course, you will still only be allowed to begin working on H-1b until Oct 1.
