Legal Question in Immigration Law in New Jersey

H1 Visa laws

Hi there,

I am currently on H1B Visa. I left firm A on Jan 31st 2003. Firm B filed for my H1B the same day. But I didn't start working for them right away. How much gap in working (i.e. having pay stubs etc.) is ok if the firm B filed for my H1 right away. I do not have pay stubs showing I started working with them from Feb 1st, 2003. From what date should I have the pay stubs etc...I am going to begin my green card processing soon.

Just needs pay stubs showing he worked for company A up to January 31.Doesnt

need pay stubs for company B.

Technically you should be gainfully employed during any time that you are in H-1 status. When transferring your visa from one company to the next there may be instances where a lapse in pay stubs may be allowable but we would have to review your file to advise you more specifically.
