Legal Question in Immigration Law in New Jersey

H1 visa status

Todays date: 23 july 01

My H4 to H1 transfer got approved on 13th April

but my employer is withholding I-797 approval notice due to the economic slump,says they will send it only when they have a project for me.

I have not applied for an SSN.

Am I out of status? What can I do? My H4 visa is valid till 2003.

Technically, you are out of status if the company that sponsored you is not paying you while you are on the bench. You will need to go to the consulate of your country of citizenship to apply for a new H-4. You should request at least a copy of your approval notice.
