Legal Question in Immigration Law in New Jersey
Hi.
I am on a J-1 trainee VISA without the 2 years period. The J-1 will expire on July 25, 2010.
I am looking for a job with another employer as an environmental engineer in PA and NJ. I got an interest from a company and I would like to know which VISA I can apply for and when and how long will last the process so to understand when I can start to work with them.

Hi,
As you are not subject to the 2 year home country requirement, the employer can file H1B petition for you. The start date will be Oct. 01, 2010 due to visa cap issues. There is a 30-day grace period in H1B status, so you will need to either depart the U.S. in the period between J1 expiration and Oct. 01, or else change to another nonimmigrant visa category such as B2 (visitor).
You should speak with prospective employers about filing H1B petition for you, and whether you can select your own attorney to prepare the petition, which must be signed by the employer.
