Legal Question in Immigration Law in New Jersey

My husband was deported back to Mexico in Jan.2010. If he crosses the border again ILLEGALLY can he go to jail? He was deported because of a domestic violence charge.

Yes, he is subject to federal criminal prosecution for illegal reentry. There are two other avenues for him to return lawfully. One would be to apply for permission to reapply for admission to the U.S. using a visa petition from you to him. Or you can pull his court file and determine if the immigration judge lawfully deported him. If not, you can move to reopen the case and parole him back into the U.S.
