Legal Question in Immigration Law in New Jersey

I have an employee who is returning to Mexico after several years of employment. He came here illegally, and is now married with 2 children under the age of 5 and born in the states. His wife is not here legally. He is planning to return to Mexico after a long absence to see family. He would like to return to the US, but since he was here illegally, he doesn't seem to be able to return. Are there any options he can try prior to his departure? Because his children are US citizens, does this improve his chances? what do you suggest? I was under the impression that he was attempting to secure his status legally, but that seems not to be the case now. He's a good employee and a very decent person. I would like to help if there is a way.

There are lots of questions to ask both him and his wife before determining his status in the United States and whether he would be able to return to the US if he leaves now. If he wants to be able to return to the US, legally and in the near future, he should speak with an immigration attorney before leaving.
