Legal Question in Immigration Law in New Jersey
L2 to H1 and EAD
I am on L1 in US for the past 6 months and have an approved EAC for H1B. My wife has an EAD on L2 and she is currently working. Kindly request you to answer the following questions:
1. How can she convert her L2 visa to H1B without a quota and is there any waiting period?
2. I will not be travelling outside US to get my stamping for H1B. But I will be legally working on H1B from October 1st. Will my spouse be able to continue to work on L2 (Please note: I have filed her H4)?

1) She will be subject to the quota.
2) She will no longer have her L2 after you are on H1.
