Legal Question in Immigration Law in New Jersey

I was on L1 visa in US from 2008 through july 2011. My visa did not get extended so went back to india. I stayed there for 6 month. I applied new H1B in India and got it stamped and back to USA on Feb 2012. So my question is how many years I can stay in USA? Does my L1 duration will be counted for 6 years limit period?

Hi,

There is an aggregate 6-year L1/H1B period of stay permitted. The clock can be reset if you depart the U.S. for one full year. However, you did not do so, and therefore the time you were in the U.S. in L1 status (3 years) will be subtracted from the total amount of time (6 years) you can spend in the U.S. in H1B status.
