Lawyer not returing unused money

Hello Sir,

I have applied for a greencard(GC) through employer, I did initiated the GC process but due to some reason I didn't complete the process, So lawyer hasn't prepared any of the paper for me because I asked him to stop the GC process even before he can start it. Only thing he did he send me a form to fill for GC(Labor cert.)(which I never filled). Now I have paid him $2000 before the start of process. As he hasn't done anything for me, I expect him to return my money with deducting the hours he has spent.

He says lawyer fee is not refundable. As I have given the money through my employer I don't have any written agreement with lawyer.

Sir, Please suggest if there is any way of getting refund.

Probably not, if the lawayer was representing the employer. If you paid your employer, then the employer may need to refund your money, however, it begs the question, of what is your status with immigration? and with this employer?

It all depends on the retainer agreement - it appears the agreement for legal services is between your employer and the attorney - as such he appears to represent the employer and not you.

However you say you paid the lawyer through your employer so I am a bit confused.
