Legal Question in Immigration Law in New Jersey

Length of stay on H1B

I came to the U.S. on H4, stayed here for 2 months and went back to my home country....stayed there for 11 months, and then came back and stayed in the U.S. on H4 for another 6 months. I am on H1B now....would this time spent on H4 be deducted from my total time on H1 of 6 years, and if yes, would the total time deducted from my H1B be 2+ 6 months, or 2+11+ 6 months? I was under 21 when I was on H4....does that change anything about my H1B remaining time? Thanks so much for your time.

Re: Length of stay on H1B

H-4 time is counted towards the 6 years but usually it is only for time actually spent in the U.S. in H status. I would need to see your travel history and your status validity dates to advise you properly.

If you would like you may contact my office at (732) 985-1310 to set up and appointment.

Sincerely,

Sameer Kumar
